General

This site acts as the window for bidders to bid on sellers' auctions.
By completing the registration process to become a member, you expressly agree to be bound by this Agreement.
By registering / bidding at Pennylord, the user warrants that they are legally capable of entering into binding contracts and that they are at least 18 years old.

You expressly agree to:

(a) provide certain current, complete, and accurate information about yourself

(b) maintain and update your account as required.

You agree as a member of the site and in your use of the service not to use a false or misleading name or a name that you are not authorized to use.

Membership is non-transferable. You may change information on existing membership account only to update your member account. Once a party becomes a member of the site, the member will select a user name and a password. Furthermore, members are entirely responsible for any and all activities, which occur under a Member's ID and password. Member agrees to immediately notify PennyLord.com of any unauthorized use of member's ID or any other breach of security known to member. PennyLord.com reserves the right to cancel the accounts of members who are have not logged in for (3) months or more.

Registered Members may request their membership to be closed at any time, however, PennyLord.com will not process the request for any member currently holding the highest bid on an open auction until such time that the member loses status as the high bidder or the auction closes. 

Member acknowledges that content appearing on the site may be protected by copyrights, trademarks or other proprietary or personal rights and those applicable laws will govern the Member's use of such content.

Pennylord is not a lottery, a raffle, sweepstakes or any other method of gambling. It is an auction where it is certain that the highest bidder buys the item at the highest bidding price once the auction timer has counted down to 0 (zero). The timer starts again once someone places a bid. For bidders that do not win the item they were bidding for, we offer compensation by having an option to buy the item from our website at set retail price . We will credit the cost of half of the bids that were made towards the final purchase price of the item, taking the cost of one bid equal to $0.80 USD. For example: If a bidder makes 8 bids but does not win, (and chooses to buy the item from us at retail price,) we will credit $3.20 USD towards the retail price of the item. Rights To Suspend Account

Pennylord.com reserves the right suspend or cancel the member’s account immediately and without notice if Terms and Conditions are not followed.

Your Conduct

Any unlawful, harassing, libelous, abusive, obscene or otherwise objectionable material is prohibited.

The payment terms and conditions must be abided by seller of any item purchased, and to pay in full any and all fees due to PennyLord.com upon receipt of an invoice.

Sending unsolicited offers or commercial email to other users is prohibited.

Service is subject to all applicable state, national and international laws and regulations.

PennyLord.com retains the right to determine whether your conduct is consistent with the letter and spirit of these Terms & Conditions and may immediately terminate your use of the service if your conduct is found to be inconsistent with these Terms & Conditions, or may be referred to the appropriate authorities.

Bidding

Bidding rights, so-called “bids”, have to be purchased by users prior to online bidding. Only registered users can submit the convenient online bids. The bids must be paid for in advance. When the bids are purchased and deposited into the user’s Pennylord account, a contract for the purchase of the bids materializes. The invoice amount for this is due immediately. If a user is suspended, all of their bids will be lost and are not to be refunded.

Bid fees is a membership charge that helps us provide our users with affordable prices.

Payment can be made by credit card or via PayPal.

Should a payment not be honored for a user, a returned payment fee will be charged. Solely the user shall be responsible for these fees. Pennylord reserves the right to block access to the user account until payment in full of the invoice amount, including any fees due to returned payment, etc., and to withhold any outstanding deliveries until payment in full.

All bids are non-refundable.

Auction Terms

Bid manipulation of any kind is expressly forbidden. Members found engaging in any form of bid manipulation will be permanently suspended from the PennyLord.com service.

You may not bid on an item for the purpose of maximizing other members' bids. Shill bidding or the use of secondary registrations, associates or aliases to artificially raise the bidding on an item is strictly prohibited. Assets are listed for the specified bidding periods shown on the site and are deemed "sold" at the close of bidding which will be set at a time pre-determined by the Seller. Each Asset will have a description and disclosure information on the Site, as well as any additional conditions of sale provided by the seller. Once bidding commences, bidders may make a bid at any time prior to closing of the bidding. Some items may have an undisclosed reserve. If there are no bids, then the seller is not obligated to sell the Asset.  

PennyLord.com is obligated to contact the winning bidder within three (3) business days to complete the transaction. After three (3) business days if the seller is unable to contact the winning bidder, for whatever reason, the seller may, in its sole discretion

(a) Continue to attempt to contact the high bidder

(b) Contact the second highest bidder and sell the Asset to the second highest bidder or

(c) Re-list the asset on the site. By selling an Asset to the next highest bidder, PennyLord.com is not releasing any claims he/she/it may have against the highest bidder for non-performance. Once the seller contacts the winning bidder, the seller and winning bidder shall complete the settlement of the purchase and sale of the Asset.

In order to participate in pennylord auction site,the user agrees to register as a member. There is no fee for initial registration but the user agrees to pay a membership fee of $1 up front for each potential bid.

Release and Indemnification

You further agree to indemnify and hold PennyLord.com, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the service, the violation of these Terms & Conditions.

Delivery

Unless otherwise stated, delivery will be made directly from our suppliers or from our warehouse to the address provided by the user. Deliveries are made solely within the 50 states of the United States (explicitly excluding the U.S. sovereign territories of Guam, Puerto Rico and the U.S. Virgin Islands). Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. PennyLord.com shall be entitled to involve third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item from transport or packaging damaged during transport is to be reported to PennyLord.com upon taking delivery.
Should PennyLord.com not be able to deliver the item ordered, PennyLord.com shall be entitled to substitute the item with a comparable replacement product with the same or better features, or provide a refund if this is the user’s preference.

Privacy Policy

PennyLord.com keeps your details, on site history, details of transactions, address, telephone number(s) and banking details securely filed and under no circumstances, other than legal requirement, will these be divulged to any other person unless specifically instructed by yourself in writing.

Pennylord reserves the right, at its sole discretion, to change, modify, add or remove any portion of these terms in whole or in part, at any time. Changes to the terms will be effective when notice of such changes is posted.

Laws

These Terms and Conditions shall be governed by and construed in accordance with the laws of USA. You and PennyLord.com agree to submit to the exclusive jurisdiction of the courts of USA.

You and PennyLord.com agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred and you and PennyLord.com forever waive any such cause of action.

The section titles in these Terms & Conditions are solely used for the convenience of the parties and have no legal or contractual significance.
